• Making an application under the Record Deletion Process

     

    The guidance issued in regards to the Record Deletion Process contains a table that shows the circumstances in relation to which an application can be made.  These circumstances include where an application is being made for the early deletion of biometric information in accordance with legislation and circumstances when the biometric information has been deleted by automated processes and you are seeking only the deletion of their PNC record.  In all circumstances, the grounds for deletion must be clearly stated in your application.  

     

    The following principles for making an application apply:

     

     

    • Applications will not be accepted under this process if you have been convicted of an offence in any court: a separate process exists for appealing or disputing a sentence or court convictions. In the absence of an application being made, records relating to your court conviction will be retained on national police systems until you are deemed to have reached 100 years of age.  
     
    • The only exception to the above is if you have been convicted of an ‘Excluded Offence’ in which case your biometric information will be deleted in accordance with an agreed criteria set out in the Protection of Freedoms Act 2012.  However, your PNC record will be retained until you are deemed to have reached 100 years of age.
     
    • Applications will be accepted under this process if you have received an ‘Out of Court’ disposal e.g. a Simple Adult Caution, provided you can evidence the grounds for making such an application as set out in the guidance. In the absence of an application being made, your PNC record will be retained until you are deemed to have reached 100 years of age.

     

    • If you are seeking the deletion of more than one arrest event at a time then you will need to submit an application in respect of each event. This will then enable you to select the relevant ground(s) and outline the circumstances specific to that event and will avoid any confusion as to exactly what is being requested for review under this process. However, please note that a proof of identity and a proof of current address need only be submitted once.
